Any conflicting conditions or conditions divergent from these General Terms and Conditions are not accepted and are hereby emphatically objected to by Deltanet Services. Conflicting conditions of the customer only apply when Deltanet Services has explicitly agreed in written form.

b) Deltanet Services is at any time entitled to change or amend these General Terms and Conditions. For contracts that were placed before the change of the General Terms and Conditions, the version that was valid at the point of the order applies.

II. Fundamental Features of Deltanet Services

Deltanet Services offers a range of products and services encompassing IT support, IT consulting, and Microsoft activation keys. These codes and keys are exclusively delivered via email, ensuring swift and convenient access. Our services prioritize remote IT support, enabling efficient and seamless assistance to address your needs. We do not engage in the sale or delivery of physical DVDs or CDs, focusing only on remote solutions for your IT requirements.

III. Customer Requirements

Depending on the product or services requested, to be able to use Deltanet Services, the customer may need to fulfill certain requirements. These requirements often include the purchase of hardware equipment, account creation, and the purchase or download of necessary software. The customer is responsible for the legal relationships with the operating company and any associated costs.

IV. Risks for the Customer Regarding the Services

a) Deltanet Services takes all reasonable precautions to keep the customer’s account information confidential and protect against third-party access. The customer is obligated to enhance security through encrypted data transmission and password changes after service provision.

b) Deltanet Services is not an operator of Microsoft or any other technology companies that offer products and services. Therefore, we do not assume responsibility for circumstances beyond our control, particularly with regard to the accessibility or functioning of the specific technology after the completion of our service provision.

V. Steps to the Conclusion of the Contract

a) The customer selects a product by clicking the “buy now” or “Add to Cart” button, adding it to the shopping cart. The customer can add more products to the cart and view its contents. After the selection, the customer clicks “pay now” to make a binding offer to Deltanet Services.

VI. Conclusion of the Contract

a) The product catalog displayed on this website is an invitation to the customer to submit an offer, not a legal offer. The contract is concluded only when Deltanet Services confirms the order.

b) After the customer’s offer is received, Deltanet Services sends an order confirmation, and the customer is responsible for ensuring their email’s reachability.

VII. Payment

a) Payment methods include advance payment (bank transfer, credit card, debit card) and PayPal. Debit and cash on delivery are not available. Payment on account may be offered in certain circumstances and is at the discretion of Deltanet Services.

b) The customer can only offset a claim that has been legally decided or is undisputed.

c) The customer can exercise a right of retention only when the counterclaim is based on the same contractual relationship.

VIII. Scope of Services and Service Reservations

a) Deltanet Services provides services according to the current status of the software. Deltanet Services reserves the right to change services as long as the core service content remains unaffected.

b) Deltanet Services transmits rights to the customer in compliance with the rights held with the product operator.

c) Deltanet Services may withdraw from the contract if the object of services is not received despite a previous agreement.

IX. Service Time and Default

a) Services are provided after payment is received.

b) The delivery deadline is stated in the product description. The customer can withdraw from the purchase if services are not possible due to extraordinary circumstances.

c) In case of failure to comply with the delivery deadline for other reasons, the customer may set an adequate grace period in writing and withdraw from the contract after the expiration.

X. Receipt of Services

The procedures for services and receipt of services by the customer are adapted to the specific circumstances of the service or software, as described in the product description.

XI. Limitation of Liability

Deltanet Services’ liability is limited to criminal intent and gross negligence. This does not apply to injuries to life, body, or health, claims regarding breach of cardinal obligations, or compensation for damage caused by delay.

XII. Guarantee

The guarantee is provided in accordance with legal provisions.

XIII. Reservation of Ownership

Customer rights are transferred upon full payment.

XIV. Additional Observations

a) The prices listed include legal sales tax but do not include delivery costs.

b) Contract data, including the wording of the contract and the General Terms and Conditions, are saved by Deltanet Services. Customers may request this data via email. Customers can also print or save the contract data during the order transaction.

c) The contractual language is in English. Contents in other languages on this website are non-binding translations.

d) For customers who are merchants or have no general jurisdiction within the country, the United States is the exclusive local jurisdiction for disputes arising from this contractual relationship.

e) United States law applies, excluding the Uniform Law on the International Sale of Goods (CISG).

f) In case one clause of this agreement becomes entirely or partially ineffective, the remaining regulations remain unaffected, and legal specifications apply in place of the ineffective regulation.
